DECISION & ORDER ON MOTION

Motion by the appellant for the assignment of counsel to prosecute an appeal from a judgment of the Supreme Court, Queens County, entered December 17, 2008. The appellant's motion for leave to prosecute the appeal as a poor person was granted on May 22, 2009.
