Appeal by Fernando Rivera from an order of the Family Court, Suffolk County, dated January 7, 2009. By decision and order on motion dated June 4, 2009, the appellant was given until July 31, 2009, to perfect the appeal. The appellant's brief was rejected as untimely on August 3, 2009, and the appellant has not sought an enlargement of time to perfect.
Now, on the court's own motion, it is
ORDERED that the appeal is dismissed, without costs or disbursements.
