ORDERED that the order on application of this court dated July 28, 2009, which granted an application by the appellant pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to perfect an appeal from an order of the Supreme Court, Kings County, dated September 26, 2008, is amended by deleting therefrom the date "September 10, 2009," and substituting therefor the date "October 28, 2009".
