| DECISION & ORDER ON MOTION |
Motion by Friars of the Atonement, Inc., for leave to intervene as a respondent on an appeal from an order of the Surrogate's Court, Putnam County, dated January 22, 2009. Application by Elaine Villafana pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to serve and file a brief.
Upon the papers filed in support of the motion and the papers filed in relation thereto, and upon the application, it is
ORDERED that the motion and application are granted; and it is further,
ORDERED that the Friars of the Atonement, Inc., shall serve and file its brief on or before September 30, 2009; and it is further,
ORDERED that Elaine Villafana shall serve and file her brief on or before October 14, 2009.
