DECISION
On the court's own motion, motions by appellant's counsel and the People returnable June 30, 2009 are consolidated for purposes of disposition.
Motion by assigned counsel, Richard Herzfeld, Esq., to be relieved of representing appellant on the appeal is granted.
Motion by respondent to dismiss the appeal as abandoned is granted (see People v Cullum, 170 AD2d 524 [1991]; People v Jinks, 140 AD2d 371, 372 [1988]).
