It is Ordered that the defendant-respondent's incomplete motion to vacate the stay of the trial and the appellant's untimely notice of cross-motion are decided as follows. The stay of the trial is continued to and including October 9, 2009. If the appeal is perfected by said date, the stay continues pending the determination of the appeal. Otherwise, the trial may proceed after said date.
