Motion by the defendant, pursuant to CPL 450.90 and 460.20 for a certificate granting leave to appeal to the Court of Appeals from a decision and order on application dated May 15, 2009, which denied the defendant's application for leave to appeal to this court from an order of the County Court, Suffolk County, dated January 15, 2009.
