Motion by the appellant to stay all proceedings in an action entitled Ozeri v Ozeri, pending in the Supreme Court, Suffolk County, under Index No. 14/08, pending hearing and determination of an appeal from decision of the Supreme Court, Suffolk County, dated June 26, 2009.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that on the court's own motion, the notice of appeal from the decision dated June 26, 2009, is deemed to be a notice of appeal from an order of the same court dated July 27, 2009 (see CPLR 5512[a]); and it is further,
ORDERED that the motion is denied.
