| DECISION & ORDER ON MOTION |
Motion by the appellant to enlarge the time to perfect an appeal from an order of the Family Court, Queens County, dated October 31, 2008, on the ground that assigned counsel has been unable to contact the appellant. By order to show cause dated July 27, 2009, the appellant was directed to show cause before this court why an order should or should not be made and entered dismissing the appeal on the ground that he has abandoned the appeal, and the motion to enlarge time was held in abeyance in the interim.
Upon the court's own motion and no papers having been filed in opposition thereto, it is
ORDERED that the appeal is dismissed, without costs or disbursements; and it is further,
ORDERED that the motion to enlarge time to perfect the appeal is denied and assigned counsel is relieved from representing the appellant on the appeal.
