On the court's own motion, it is
ORDERED that its decision and order on motion dated August 26, 2009, in the above-entitled appeal, which denied a motion by the appellant, on an appeal from an order of the Supreme Court, Westchester County, dated September 30, 2008, is amended by deleting from the recital paragraph thereof the words "the papers filed in opposition", and substituting therefor the words "no papers having been filed in opposition".
