DECISION & ORDER ON MOTION

Motion by the appellant Joyce J. to stay enforcement of an order of the Family Court, Kings County, dated July 29, 2009, pending hearing and determination of an appeal therefrom, and for poor person relief.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is to stay enforcement of the order dated July 29, 2009, is denied; and it is further,

ORDERED that the branch of the motion which is for poor person relief is denied as academic in light of the order on certification of this court dated September 1, 2009.
