DECISION & ORDER ON MOTION

Motion by the respondent to hold in abeyance an appeal from a judgment of the Supreme Court, Queens County, rendered October 23, 2008, pending determination of a motion to disqualify the appellant's attorney in an action entitled People v Latif, pending in the same court under Ind. No. 1824/07.

Upon the papers filed in support of the motion and the papers filed in opposition or relation thereto, it is

ORDERED that the motion is granted and the appeal is held in abeyance pending determination of a motion to disqualify the appellant's attorney in an action entitled People v Latif, pending in the Supreme Court, Queens County, under Ind. No. 1824/07; and it is further,

ORDERED that the respondent shall notify the court expeditiously when the motion to disqualify is determined.
