Petitioner having moved for permission to proceed as a poor person on the CPLR article 78 proceeding transferred to this Court by an order of the Supreme Court entered in the Office of the Clerk of the County of Orleans on July 15, 2009, and for permission to submit one brief,
Now, upon reading and filing the affidavit of Johnny Bunting sworn to August 10, 2009, the notice of motion with proof of service thereof, and due deliberation having been had thereon,
It is hereby ORDERED that the motion for permission to proceed as a poor person be, and the same hereby is, granted, and the motion is otherwise denied, and
It is further ORDERED that petitioner's briefs shall be filed and served on or before October 13, 2009, respondent's briefs shall be filed and served on or before November 17, 2009, and the proceeding is hereby removed from the December 7, 2009 day calendar and added to the calendar for the term of the Court commencing January 19, 2010.
Memorandum: The grant of poor person relief authorizes petitioner to proceed on the minimum number of copies of his brief, as set forth in 22 NYCRR 1000.14 (c).
