It is hereby ORDERED that the motion and cross motion be, and the same hereby are, granted to the extent that the appeals from the decisions entered January 12, 2009 and May 28, 2009 and the cross appeal from the order entered August 26, 2008 are hereby dismissed, and the appeals and cross appeal are deemed to have been taken from the judgment of the same Court entered June 4, 2009 (Docket No. CA 09-01780).
