| ORDER ON APPLICATION |
ORDERED that the order on application of this court dated August 25, 2009, in the above-entitled matter, which granted an application by the City of New Rochelle for leave to withdraw its appeal from an order of the Supreme Court, Westchester County, dated December 12, 2008, is amended by deleting from the first paragraph the words "the appellant" and substituting therefor the words "the City of New Rochelle," and by inserting in the decretal paragraph the words "of the City of New Rochelle" following the words "the appeal."
