Motion by the appellant to stay the trial of the above-entitled action in the Civil Court of the City of New York, County of Queens, pending hearing and determination of an appeal from an order of the Supreme Court, Queens County, entered May 15, 2009, and, in effect, to vacate so much of a decision and order on motion of this court dated August 7, 2009, as dismissed an appeal from an order of the same court dated June 16, 2009.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion is denied.
