DECISION & ORDER ON MOTION

Motion by Thomas F. Liotti, Esq., to be assigned as attorney for the appellant, nunc pro tunc, on an appeal from a judgment of the County Court, Nassau County, rendered August 18, 2003, which was determined by decision and order of this court dated October 7, 2008. The appellant's motion for leave to proceed as a poor person was granted on January 16, 2004.

Upon the papers filed in support of the motion and the papers filed in relation thereto, it is

ORDERED that the motion is granted; and it is further,

ORDERED that the Thomas F. Liotti, Esq., is assigned as attorney for the appellant nunc pro tunc.
