Motion by the appellant, in effect, for leave to reargue his prior motion to extend his time to file a motion for leave to appeal to the Court of Appeals from a decision and order of this court dated January 13, 2009, which determined an appeal from an order of the Supreme Court, Kings County, dated June 8, 2007. The prior motion was determined by decision and order on motion of this court dated June 15, 2009.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied.
