| DECISION & ORDER ON MOTION |
Motion by the appellant on an appeal from an order of the Surrogate's Court, Queens County, dated October 29, 2008, for leave to reargue his prior motion, inter alia, to strike the respondent's brief on the ground that it is based on "falsehood and oriented to mislead the court" and "to reargue vacator [sic] of stay and, on reargument, to reinstate" the stay, which was determined by decision and order on motion dated June 15, 2009. Separate motion by the appellant "to disallow [the sale] of the apartments" and to reinstate a certain stay pending hearing and determination of the appeal. Application by the respondent to preclude the appellant from making further motions.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, and upon the application, it is
ORDERED that the motions and the application are denied.
