Motion by the New York City Department of Housing Preservation and Development for leave to reargue a proceeding pursuant to CPLR article 78 to review its determination dated June 7, 2006, which was determined by decision and judgment of this court dated June 9, 2009, or, in the alternative, for leave to appeal to the Court of Appeals from a decision and judgment of this court.
Upon the papers filed in support of the motion and the papers filed in opposition and in relation thereto, it is
ORDERED that the motion is denied, with $100 costs.
