ORDERED that its decision and order on motion dated May 18, 2009, in the above-entitled appeal, as amended by decisions and orders on motion dated June 30, 2009, and August 7, 2009, which determined a motion by the nonparty-appellant, on an appeal from an order of the Supreme Court, Nassau County, dated August 12, 2008, is amended by deleting therefrom the date "June 17, 2009," and substituting therefor the date "September 22, 2009," and the CPLR 2105 statement submitted by the appellant is accepted for filing.
