Motion by the defendant Rachid Bellil for leave to appeal to this court from an order of the Appellate Term, Second, Eleventh, and Thirteenth Judicial Districts, dated December 5, 2008, which reversed an order of the Civil Court of the City of New York, Queens County, entered November 14, 2007 and to stay enforcement of the judgment entered in the above-entitled action pending hearing and determination of the appeal.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied.
