Now, upon reading and filing the affidavit of James L. Dowsey, sworn to August 3, 2009, the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion be and the same hereby is granted, and James L. Dowsey III, Esq. is hereby relieved of his assignment on this appeal, and

It is further ORDERED that the said appeal is dismissed as having been abandoned.
