Motion by the plaintiffs for leave to appeal to this court from an order to show cause of the Supreme Court, Kings County, dated August 17, 2009, and to enjoin the respondents from, inter alia, distributing the proceeds of a certain mortgage, pending hearing and determination of the appeal.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied as academic as the Supreme Court, Kings County, determined the motion that was instituted by the order to show cause dated August 17, 2009.
