On the Court's own motion it is Ordered that the above entitled motion, decided, on default on September 14, 2009, is hereby recalled and vacated. By prior order of this Court, dated August 27, 2009, the appellants' time to perfect the appeal of the November 9, 2007 order of the Civil Court was extended to the December 2009 term. Accordingly, the subsequent order dismissing this appeal is vacated and the appeal is to be perfected for the December 2009 term.
