appellant, on or before October 14, 2009, deposits $40,000- with the Clerk of the Civil Court and pays the August, September and October 2009 use and occupancy [in the amount of $13,000 per month as per the 6/16/09 stipulation] to the landlord, without prejudice. In the event of appellant's failure to comply with the orders of this Court, the petitioner may move on five days' notice for an order vacating the stay.
