| DECISION & ORDER ON MOTION |
Motion by the appellant for leave to withdraw a brief filed in connection with an appeal from a judgment of the County Court, Nassau County, rendered July 10, 2006, and file a replacement brief.
Upon the papers filed in support of the motion and the papers filed in relation thereto, it is
ORDERED that the motion is granted; and it is further,
ORDERED that the appellant's brief is stricken and on or before October 14, 2009, the appellant shall serve and file a replacement brief; and it is further,
ORDERED that the respondent shall serve and file a brief in response to the appellant's replacement brief on or before December 14, 2009.
