On the court's own motion, it is
ORDERED that its decision and order on motion dated September 21, 2009, in the above-entitled case is recalled and vacated, and the following decision and order on motion is substituted therefor:
Motion by the appellant pro se to relieve counsel assigned to prosecute an appeal from an order of the Supreme Court, Kings County, dated February 4, 2008, and for the assignment of new counsel.
Upon the papers filed in support of the motion and the papers filed in relation thereto, it is
ORDERED that the motion is denied without prejudice to the appellant notifying this court after his assigned counsel files a brief, that he wishes to file a supplemental brief (see 22 NYCRR 670.12[g], [h]).
