DECISION & ORDER ON MOTION

Appeal by Thomas Kazanji from an order of the Family Court, Westchester County, dated February 27, 2009. By decision and order on motion dated August 24, 2009, the appellant's time to perfect the appeal was enlarged until September 25, 2009. The appeal has not been perfected and the appellant has not sought a further enlargement of time.

Now, on the court's own motion, it is

ORDERED that the appeal is dismissed, without costs or disbursements, for failure to perfect in accordance with the rules an prior orders of this court.
