| DECISION & ORDER ON MOTION |
Motion by the appellant pro se, inter alia, to stay her eviction from the subject premises, pending hearing and determination of appeals from two orders of the Supreme Court, Queens County, entered July 14, 2009, and August 17, 2009, and an undated notice of eviction.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that on the court's own motion, the appeal from the undated notice of eviction (Appellate Division Docket No. 2009-08563), is dismissed, without costs or disbursements, on the ground that no appeal lies from an undated notice of eviction (see CPLR 5701); and it is further,
ORDERED that the motion is denied.
