| DECISION & ORDER ON MOTION |
Motion by Doreen Harris on appeals from two orders of the Supreme Court, Kings County, dated June 23, 2009, and September 8, 2009, respectively, inter alia, to stay her eviction from the subject premises and for poor person relief.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that on the court's own motion, the appeal from the order dated June 23, 2009 (Appellate Division Docket No. 2009-06070), is dismissed, without costs or disbursements, on the ground that the order dated June 23, 2009, was rendered academic by the order dated September 8, 2009; and it is further,
ORDERED that on the court's own motion, the stay of the appellant's eviction from the subject premises contained in the decision and order on motion of this court dated August 13, 2009, is vacated; and it is further,
ORDERED that the motion is denied.
