It is Ordered that the motion and cross motion are consolidated for disposition. The stay is condition that the appellant, on or before October 15, 2009, tenders the four $930.50 D.S.S. checks to the petitioner, without prejudice and deposits $762.00 with the Clerk of the Civil Court-New York County.
