| DECISION & ORDER ON MOTION |
Motion by Richard J. Pruzan to consolidate appeals from two orders of the Supreme Court, Queens County, dated November 7, 2008, and May 28, 2009, respectively, or to calendar the appeal on the same day. Separate applications by the plaintiffs-appellants and the defendants-appellants in Appeal No. 1, pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to perfect the appeals from the order dated November 7, 2008.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, and upon the applications, it is
ORDERED that the motion is granted to the extent that the appeals will be calendared together and will be argued or submitted on the same day, and the motion is otherwise denied; and it is further,
ORDERED that the applications are granted and the time to perfect the appeals from the order dated November 7, 2008, is enlarged until November 13, 2009, and the joint record or appendix on the appeals and the briefs of the plaintiffs-appellants and the defendants-appellants in Appeal No. 1 must be served and filed on or before that date.
