Motion by the respondents for leave to appeal to the Court of Appeals from a decision and order of this court dated July 7, 2009, which determined an appeal from an order of the Appellate Term of the Supreme Court, Ninth and Tenth Judicial Districts, dated March 11, 2008, which reversed a judgment of the District Court, Suffolk County, Fourth District, entered October 30, 2006.
