| DECISION & ORDER ON MOTION |
Motion by the appellant, inter alia, to stay enforcement of an order of the Supreme Court, Kings County, dated May 29, 2008, pending hearing and determination of an appeal therefrom, and for a preference in the calendaring of the appeal. Cross motion by the respondent to impose a sanction upon the appellant, for an award of an attorney's fee and costs, and to preclude the appellant from making further motions in connection with this appeal without prior leave of the court.
Upon the papers filed in support of the motion and the cross motion, and the papers filed in opposition thereto, it is
ORDERED that the motion is denied; and it is further,
ORDERED that the branches of the cross motion which are to impose a sanction upon the appellant and for an award of an attorney's fee and costs are denied; and it is further,
ORDERED that the branch of the cross motion which is to preclude the appellant from making further motions in connection with this appeal without prior leave of the court is granted.
