| DECISION & ORDER ON MOTION |
Motion by the respondent to vacate a decision and order of this court dated December 1, 2003, which determined an appeal from an order of the Supreme Court, Queens County, dated August 22, 2002, to remand the above-entitled action for a jury trial, and to issue a protective order.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied, with $100 costs; and it is further,
ORDERED that the respondent is precluded from making further motions in connection with the above-entitled appeal without prior leave of the court.
