ORDERED that the motion for an extension of time to perfect the appeal is denied, without costs, and without prejudice to renewal supported by an affidavit setting forth facts showing merit to the appeal as required by section 800.12 of this Court's Rules of Practice, and it is further

ORDERED that the motion for permission to proceed as a poor person is granted, without costs, only to the extent that the filing fees required by CPLR 8022 are waived.
