ORDER ON APPLICATION

Joint application by Rose Rogers and Victor P. Cunneen pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to perfect appeals from an order of the Supreme Court, Nassau County, dated March 13, 2009.

ORDERED that the application is granted and the time of Rose Rogers to perfect her appeal is enlarged until December 7, 2009, and the joint record or appendix on the appeal and the brief of Rose Rogers must be served and filed on or before that date; and it is further,

ORDERED that Victor P. Cunneen shall serve and file an answering brief, including points of argument on his appeal, on or before January 12, 2010 (see 22 NYCRR 670.8[c][3]); and it is further,

ORDERED that the plaintiff-respondent and the defendant-respondent shall serve and file their respective briefs on or before February 16, 2010; and it is further,

ORDERED that Rose Rogers and Victor P. Cunneen shall serve and file their reply briefs on or before March 3, 2010.
