DECISION & ORDER ON MOTION

Motion by counsel assigned to represent the petitioner-respondent by the Family Court, Westchester County, to be relieved, and for the assignment of new counsel to represent the petitioner-respondent on an appeal from an order of the Family Court, Westchester County, entered May 26, 2009.

Upon the papers filed in support of the motion and no papers having been filed in opposition to or in relation thereto, it is

ORDERED that the motion is granted, and Joseph P. Villanueva, Esq., 700 White Plains Road, Suite 255, Scarsdale, NY 10583, is directed to turn over all papers in the action to the new attorney for the petitioner-respondent herein assigned; and it is further,

ORDERED that pursuant to Family Court Act § 1120, the following named attorney is assigned as attorney for the petitioner-respondent to represent the petitioner-respondent:
