ORDERED that its decision and order on motion dated October 13, 2009, in the above-entitled matter, which granted a motion by the appellant, on an appeal from a judgment of the County Court, Dutchess County, rendered July 1, 2009, is amended by deleting from the caption "Ind. No. 29/08," and substituting therefor "Ind. No. 108/08."
