| DECISION & ORDER ON MOTION |
Motion by Jean Aronson, individually, and as executor of the estate of Callman Aronson, deceased, for leave to appeal to this court from two orders of the Supreme Court, Nassau County, dated July 28, 2009 (Appellate Division Docket No. 2009-08121), and August 17, 2009 (Appellate Division Docket No. 2009-09513), respectively. Cross motion by Gena Im, Ammar Nasir, Winthrop University Hospital, and Brian Kaufman, in effect, to dismiss the appeal from the order dated July 28, 2009, on the ground that no appeal lies as of right from an order that does not decide a motion made on notice. Application by Jean Aronson, individually, and as executor of the estate of Callman Aronson, deceased, to withdraw the appeal from the order dated July 28, 2009.
Upon the papers filed in support of the motion and the cross motion, and the papers filed in opposition thereto, and upon the application, it is
ORDERED that the motion for leave to appeal is denied; and it is further,
ORDERED that the cross motion denied as academic; and it is further,
ORDERED that the application is denied.
