ON MOTION

Motion to stay the collection of $15,000 by Tompkins County Support Collection Unit from the escrow account of the attorney for appellant.

Upon the papers filed in support of the motion and the papers filed in opposition and in response thereto, it is

ORDERED that the motion is granted, without costs, and the $15,000 in question shall remain in the escrow account of the attorney for appellant pending determination of the appeal. The motion is granted without prejudice to a motion by respondent to vacate the stay in the event the appellant fails to file and serve his record on appeal and brief on or before December 7, 2009.
