Respondent-Appellant having moved for an extension of the time to file and serve a brief and the appeals taken from an order and a judgment of Cayuga County Court, entered December 28, 2007 and rendered March 24, 2008, respectively,

Now, upon reading and filing the affidavit of Christopher D. Valdina sworn to October 6, 2009, the notice of motion with proof of service thereof, the opposing affirmation of David P. Elkovitch dated October 9, 2009, and due deliberation having been had thereon,

It is hereby ORDERED that the appeals are consolidated for purposes of perfecting and arguing the appeals, and

It is further ORDERED that the motion be and the same hereby is granted, and the time to file and serve a respondent-appellant's brief is extended to December 4, 2009, and

It is further ORDERED that appellant-respondent's time to file and serve a reply brief be and the same hereby is extended to December 31, 2009.
