| DECISION & ORDER ON MOTION |
Motion by Sompo Japan Insurance Company to stay the trial in the above-entitled action, as well as enforcement of an order of the Supreme Court, Kings County, dated February 25, 2009, pending hearing and determination of an appeal from the order. Separate motion by Turner Construction Company to stay the trial in the above-entitled action pending hearing and determination of the appeal.
Upon the papers filed in support of the motions and the papers filed in opposition thereto, it is
ORDERED that the motions are granted, and the trial in the above-entitled action, as well as enforcement of the order dated February 25, 2009, are stayed pending hearing and determination of the appeal.
