DECISION & ORDER ON MOTION FOR REINSTATEMENT

Motion by the respondent for reinstatement to the bar as an attorney and counselor-at-law. The respondent was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on June 1, 1988, under the name Steve Frederique Apollon. By opinion and order of this court dated July 15, 1996, as amended July 23, 1996, the respondent was disbarred and his name was stricken from the roll of attorneys and counselors-at-law based upon his resignation. The Grievance Committee for the Second, Eleventh, and Thirteenth Judicial Districts thereafter moved to punish the respondent for contempt, pursuant to Judiciary Law §§ 750 and 753, on the ground that he violated the order of disbarment. By decision and order on motion of this Court dated January 15, 1997, the motion was held in abeyance and the issue was referred to the Hon. Geraldine T. Eiber, as Special Referee to hear and report. By opinion and order of this Court dated October 6, 1997, the respondent was adjudged to be in criminal contempt in violation of Judiciary Law § 750(A)(3) and fined $1,000.

Upon the papers submitted in support of the motion and the papers submitted in relation thereto, it is

ORDERED that the respondent's motion is held in abeyance and the matter is referred to the Committee on Character and Fitness to investigate and report on the respondent's fitness to be an attorney, including but not limited to, whether there is any outstanding restitution still to be paid.
