It is Ordered that the motion to vacate the stay is denied, without prejudice to renew in the event the appeal is not perfected by the February 2010 term - the filing deadline is December 8, 2009. In the event of appellant's failure to comply with the orders of this court, the landlord may move on five day's notice for an order vacating the stay. No further extension of time will be granted.
