| DECISION & ORDER ON MOTION |
Motion by Frank Kandler, Deborah Kandler, and Michael Margigliano for leave to reargue their prior motion for leave to appeal to this court from an order of the Appellate Term, Ninth and Tenth Judicial Districts, dated July 10, 2008, which affirmed a judgment of the Sixth District Court, Suffolk County, entered November 21, 2006, which was determined by decision and order on motion of this court dated January 28, 2009, or, in the alternative, for leave to appeal to the Court of Appeals from the decision and order on motion of this court.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied.
