| DECISION & ORDER ON MOTION |
Motion by the appellant on an appeal from a judgment of the Supreme Court, Westchester County, entered December 30, 2008, in effect, to extend the time to comply with a decision and order on motion of this court dated September 14, 2009, which directed the appellant to serve and file a replacement record that does not contain certain material and that includes the transcripts of the proceedings on September 19, 2007, and September 20, 2007, and to serve and file a replacement brief on or before October 14, 2009.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is granted, the time to comply with the decision and order on motion dated September 14, 2009, is extended until December 10, 2009, and the first decretal paragraph of the decision and order on motion dated September 14, 2009, is amended by deleting therefrom the date "October 14, 2009," and substituting therefor the date "December 10, 2009"; and it is further,
ORDERED that no further extension of time shall be granted.
