DECISION & ORDER ON MOTION

Appeal by the petitioners from an order of the Supreme Court, Nassau County, dated March 1, 2007. By order to show cause dated September 29, 2009, the parties or their attorneys were directed to show cause before this court why an order should or should not be made and entered dismissing the above-entitled appeal on the ground that the appeal may have been rendered academic based on the passage of time.

Now, on the court's own motion, and the papers filed in response to the order to show cause, it is

ORDERED that the appeal is dismissed, without costs or disbursements, on the ground that the appeal has been rendered academic based on the passage of time.
