It is Further Ordered that defendant-appellant's motion for a stay of proceeding in the trial court is granted on condition that the defendant-appellant perfects the appeals by the February 2010 term - the filing deadline is December 8, 2009. In the event of defendant-appellant's failure to comply with the foregoing condition, the plaintiffs-respondents may move on five days notice for an order vacating the stay.
